British filmmakers urge action over illegal downloads

Award-winning producers, directors and writers in UK have called for action to tackle illegal downloads of films and TV shows which they say are threatening jobs.
The group of more than 100 including Oscar nominated directors Sir Alan Parker, Mike Leigh and Kenneth Branagh are among the household names who have called on the Government to address the problem of peer-to-peer (P2P) file-sharing and the widespread availability of illegal, free content via the internet. Writing in 'Personal View' in The Daily Telegraph on the subject of protecting film, music and video industries, Callum MacDougall, the Executive Producer of James Bond: Quantum of Solace, noted "Illegal peer-to-peer file-sharing, a practice that has grown in popularity and reach as access to the internet has widened, is putting at risk the sustainability of jobs dependent on entertainment, right the way from small production companies to high street store chains.

In the last year alone 98 million films were downloaded or streamed for free (700 times as many as were purchased online) and it is believed that 6 million people currently file-share illegally.

The revenue lost in this process means there is less to invest in generating new films, in building new ways to widen access to content for consumers and fewer opportunities to generate employment in the creative economy."

In the summer of 2004, the Motion Picture Association of America (MPAA), the main lobbying group for Hollywood's major studios, announced a new campaign aimed at slowing the illegal downloading of movies off the Internet. MPAA Representatives who held the news conference said the crackdown included both civil lawsuits and criminal prosecutions around the world. John Malcolm, the director of worldwide anti-piracy at the MPAA, said steps were taken in the U.S., the United Kingdom, France, Finland and the Netherlands. This announcement came one month after the MPAA filed its first batch of lawsuits against more than 200 individuals it accused of stealing movies off the Web. The new crackdown was targeted at people who acted as conduits between downloaders and three specific "peer-to-peer" or P2P file-sharing technologies.

These intermediaries provide users with lists of movies, songs and television shows that can be swapped with other users. MPAA followed this up by sending legal notices to Internet service providers ordering them to intervene and shut down these middlemen, also known as "trackers," "servers" and "hubs."
Almost four years later, the details of the 2004 initiative are still scant. The MPAA did not disclose the number of lawsuits filed, whether arrests were made, or the identities of the Internet service providers who received "cease-and-desist" letters. Reliable data on the prevalence of illegal movie downloads and the cost to Hollywood do not exist. The MPAA itself, which claimed it lost $3.5 billion in 2004 to the black market in physical DVDs, did not have any idea as to how much money the industry lost on the Web.

Bollywood on the other hand has never seriously addressed this issue so far. To develop a sense of rational fear among people who convert and upload the movies, and then profit from it by creating web sites listing the movies, the movie industry need to act. By successfully finding and shutting down these illegal 'entrepreneurs' we can instill a fear in others who might be thinking online movie piracy is the easiest way to make money online. Else, this will turn into a mass free-for-all racket and will result in the demise of the movie industry.
